Terms and Conditions
Croydesurf (“We/Us”) act as agent for the owners (“Owners”) of a range of holiday accommodation (“Accommodation”) hired to Customers (“You”) on a short term basis, and subject to these terms and conditions of hire (“Terms & Conditions”). By entering into a booking with Us you hereby acknowledge, accept and agree to be bound by these Terms & Conditions.
- Availability and Fees
The Croydesurf website gives information on availability of accommodation, and the fee to hire it (“Fee”). We endeavour to ensure this information is accurate, but definitive fees and availability are always subject to confirmation with us.
- Bookings
Your booking (“Booking”) must be made on a Croydesurf booking form (“Booking Form”), or via the Croydesurf website. Bookings are only confirmed once we have confirmed acceptance in writing and/or via an e-mail message.
- Payment

Postal
For Bookings made more than 8 weeks before the start of a holiday a deposit of 25% of the Fee is required to secure the booking, sent with a completed Booking Form to Croydesurf, Greystones, St Helens Close, Croyde, North Devon, EX331PW. For Bookings made within 8 weeks of the start of the holiday, the full Fee should be sent with the Booking Form.
Online
For Bookings made more than 8 weeks before the start of a holiday a deposit of 25% of the Fee is required to secure the booking, this should be done online using our secure server. For Bookings made within 8 weeks of the start of the holiday, the full Fee should be made online as directed by the Booking Form.
- Final Payment
Once the Booking is received and accepted by Us on behalf of the Owner, the balance of the Fee is payable by 8 weeks before the holiday commencing, otherwise the Booking will lapse and You will forfeit your deposit. On receipt of the balance of the Fee We will send you full directions to the Accommodation, and details of how to collect the key. You will also need to pay the appropriate damages deposit. This is fully refundable within 14 days of the final day of your holiday, subject to the property being undamaged, and in the same condition as when you arrived.
- Methods of Payment
Our preferred method of payment is online. Payment is secure via payment by credit/debit card using the RBS Worldpay secure server.
This is the simplest, quickest, and most efficient way of securing you holiday booking. We can also accept payment by cash, cheque or bank transfer. Please make any cheques payable to Croydesurf. Please note that postal payments clearly suffer postal delay, and your booking will not be confirmed until the funds are cleared, and you have received your written confirmation, (see item 2).
- Use of the Accommodation
- Arrival and Departure Times
Accommodation is, unless otherwise stated, available for occupation by you from 3pm on the first day of your Booking. Departure is by 10am on the morning of the last day of your Booking, to allow sufficient time for preparation for the next tenant. Failure to vacate by the appropriate time will cause delay in changeover to the next client, and this may incur significant increased costs. These would be deducted from your deposit.
- Sleeping Capacity
The number of people stipulated for the Accommodation must not be exceeded under any circumstances. Only those listed on the booking form may occupy the premises.
- Conduct
You must use the Accommodation responsibly and comply with any reasonable rules laid down by the Owners. The Owner (or Us on behalf of the Owner) reserves the rights to enter the property at any reasonable time on giving reasonable notice to You. You are expected to behave in such a manner that You do not cause any annoyance, distress or embarrassment to other residents and guests of adjacent properties, particularly if entering the Accommodation late at night.
- No Smoking
Without exception all properties are non-smoking. (including any balconies and patios) is strictly non-smoking. If there is evidence of smoking you will lose your refundable deposit to cover increased cleaning costs.
- Leaving the Accommodation
The accommodation must be left in the clean and tidy condition in which you found it. All linen and towels should be stripped and left in the individual rooms.
- Booking Restrictions
No bookings will be accepted from all male or all female groups. No pets other than registered assistance dogs are permitted unless otherwise stated.
- Cancellation
Once a deposit has been received, a change of dates may be acceptable at the Owners discretion, but this will incur an administrative charge, and will be subject to availability.
- Linen
Beds will be made up on arrival unless it is a sofa bed where the linen will be left out ready. You must bring your own beach towels. Linen must not be removed from the Accommodation at any point during your stay. Linen is not included for cots/cribs (if applicable).
- Motorcar and personal belongings
Baggage and personal belongings are at the hirer’s risk at all times, and no responsibility can be accepted for loss or damage to any vehicle or its contents. If items are left behind in your accommodation, we shall contact you to arrange collection or please send a payment to cover postage for them to be sent (at Your risk). Items which are still not collected after a month will be disposed of unless otherwise agreed.
- Breaches of these Terms & Conditions
If You breach these Terms & Conditions the Owner (or Us on behalf of the Owner) will have the right to terminate your Booking and if you are at the Accommodation We (or the Owner) may require you to vacate it immediately. A breach of these Terms & Conditions includes, without limitation, failure to comply with the rules relating to the Accommodation, ignoring health and safety advice or guidelines, or circumstances were your behaviour is likely (in Our opinion) to have a significant adverse effect upon nearby residents and guests. In the event of You breaching these Terms & Conditions no refund of the Fee already paid will be returnable to You.
- Damage/Cleaning
You must keep the Accommodation clean and in good order and You will be responsible for any breakages or damage. We shall be entitled, on the Owner’s instructions, to charge You the cost of remedying any breach of these obligations together with the cost of any services or goods provided. Properties must be left in the clean and tidy condition in which they are found, ie, washing up done, kitchen cleaned, including fridge/hob/oven/microwave, barbeque cleaned, bed linen removed from beds and left in correct rooms, floors swept and moped. Damages should be notified to us.
- Liability
- We will not be liable to you for any loss or damage suffered by You or any member of your party, or to any property, except to the extent that such loss or damage is caused by our negligence. Except in the case of death or personal injury our total liability to You in respect of any or all breaches of these Terms & Conditions, or otherwise in relation to the Hire of the Accommodation, shall be limited in aggregate to the Fee paid by you.
- Nothing in these Terms & Conditions will exclude either party’s liability for death or personal injury.
- Accommodation description
We aim to describe the Accommodation as accurately as reasonably possible. Should there be a specific health or mobility issue please inform us so We can double check suitability of the Accommodation for you before Booking.
- Complaints
Should You have a problem please inform us as soon as possible to give us a chance to rectify the situation. It will not be possible to give proper consideration to complaints that are made after your stay, or where we are not given the chance to rectify the issue.
- Matters Beyond Our Control
- Should the Accommodation not be available on the date of your Booking for any reason beyond our control (including, but not limited to, fire, theft, sale, natural disaster, Act of God, industrial action or any action or omission of the Owner) , a refund for the period lost shall be given to you in full and final settlement of any claims against Us.
- All the information provided by Us is given in good faith and believed correct, but we cannot be held responsible for any errors or alterations such as pubs and restaurants closing, tourist attractions changing or liability for happenings outside our reasonable control, such as breakdown of domestic appliances, plumbing, wiring, exceptional weather conditions or similar.
- Miscellaneous
- These Terms & Conditions override and supersede any and all previous versions and any previous course of dealing between the parties.
- No variation to these Terms & Conditions will be valid unless agreed to by both parties in writing.
- In the event of any inconsistency between these Terms & Conditions and of our literature, whether in a brochure or on the Croydesurf website or otherwise, the provisions of these Terms & Conditions will prevail.
- These Terms & Conditions are subject to English law and to the exclusive jurisdiction of the English courts.
- It is not intended that any third party (other than the Owners) should have the right to enforce any of these Terms & Conditions under the Contracts (Rights of Third Parties) Act 1999. It is intended that the Owners may enforce the Terms & Conditions against You.
